This article explores and unpacks the public debate on the ethics of applying selection quotas to South African international sport sides to achieve transformation, with special attention to cricket and rugby, the Proteas and Springboks respectively. I claim that for quotas to be morally called for, the racial transformation they are in service of must be morally required. Following an earlier article of mine on the subject of transformation in South African sport, I briefly reject two manifestations of the goal (...) of having the sides’ racial demographics match those of the country as a whole, and proceed to defend and develop two different transformational requirements: the ending of ongoing racial bias and the provision of equality of opportunity. I argue that while there may be a place for alternative forms of affirmative selection, the case for rigid quotas is marginal at best. While I do not argue for the claim here, it neither follows from this, nor do I believe, that the use of quotas is morally wrong. I argue only that the case for them is not particularly strong and depends, particularly, on the extent to which ongoing racial bias in selection persists. (shrink)

In this paper I offer a limited defence of “fairness” or “fair play” arguments for political obligation by focussing on one important critique of such arguments, that offered by A. John Simmons. I isolate Simmons's concentration on the idea of “accepting” benefits and argue that, among other difficulties, his criteria for when we can be said to accept a benefit from our political communities are too restrictive. While the scope of the discussion is narrow, I try to sketch ways in (...) which the failings of Simmons's critique are symptomatic of deeper problems with his libertarian approach. S. Afr. J. ?Understanding?, as I use the term, is an affective state which results from the dissolution of condemnatory judging in the face of non-standard sorts of considerations leading to such a dissolution. Rather than being a response to excuse, justification, or lack of responsible agency, understanding flows in a variety of ways from careful attention to the particulars of a wrongdoer's circumstances and situation. In this paper I try to explore why I think it is good to be the sort of (...) person who is willing to thus empathetically identify with wrongdoers and be such that exposure to those circumstances and particulars leads to the dissipation of condemnatory judgement. The suggestion I try to defend is that humility calls for it. I sketch what I take to be a normatively attractive cluster of traits which I identify with humility. And I then try to show how the person who has them will be disposed to understand wrongdoings without denying their wrongness, nor condoning them. (shrink)

Abstract Susan Moller Okin has criticized Michael Sandel's view that the family is an example of an institution that is sometimes ?above? or ?beyond? justice, and for which justice is not, under the best conditions, a virtue. She argues that he both misses the point of justice as a virtue of social institutions and that he idealizes the family, and after undertaking this ?ground-clearing?, goes on to argue that families should be just. This paper offers a qualified defense of Sandel. (...) I argue, first, that Sandel has not missed the point of justice as a virtue of social institutions. But I go on to argue, more centrally, that if we distinguish between what I call ?internal? and ?social? justice of the family, and look carefully at the conclusions of Okin's own arguments, we see that she has really argued for the social justice of the family, and that this can be maintained alongside Sandel's vision of the family as an institution within which considerations of justice are neither central, nor necessarily appropriate. I try to carve out space both for Sandel's vision of the family, and for Okin's substantive feminist conclusions about family-based gender injustice. (shrink)

Michael Sandel has criticised recent developments in, and towards, the biomedical enhancement of human beings. His view is criticised by Anton A. van Niekerk in a recent issue of this journal. Van Niekerk takes Sandel to task for rejecting enhancement tout court, for advancing inconsistencies, and for regarding enhancement as a “drive for mastery”. In this paper I argue that Van Niekerk’s critique fails. After discussing what we should mean by “enhancement”, and presenting an overview of what I call “the (...) Sandelian picture” (of enhancement), I go on to address Van Niekerk’s criticisms. The first, I argue, either begs the question or attacks a straw person. The second pays insufficient attention to things Sandel says which, once on the table, leave his “inconsistency” critique inadequately argued for. The third also rests on misunderstandings and, as such, attacks a straw person. While stopping short of defending Sandel’s position outright, and allowing that Van Niekerk makes some important critical points, I maintain the three central criticisms fall short as an argued-for critique of Sandel’s view. In this paper I attempt to unpack the current public debate on racial transformation in South African sport, particularly with regard to the demographic make-up of its national cricket and rugby sides. I ask whether the alleged moral imperative to undertake such transformation is, in fact, a moral imperative at all. I discuss five possible such imperatives: the need to compensate non-white South Africans for the injustices in sport’s racist history, the imperative to return the make-up of our national sides (...) to what they would have been in the absence of that history, the requirement that national sides be representative of the country, the need to eliminate ongoing racial bias in selection, and the obligation to provide all South Africans, regardless of their race, the opportunity to compete as equals for places in the national side. I argue that the first three, drawn from talk of “rectifying the injustices of the past,” “achieving demographic proportionality between the sides and the country,” “representivity,” and “transformation” itself, are not compelling. The remaining two are of great moral import, but that the sorts of phrases just mentioned, and which are frequently used in the debate, have little to do with those genuine moral requirements. Wittgenstein appears in turn shy and affectionate, fierce and censorious, happy to collaborate and sure of his own judgement. Four quarrels and four reconciliations are documented. Wittgenstein's struggles to publish his Tractatus may be followed, as well as his retreat from the world, his being wooed back to philosophy by Keynes and (...) Ramsey, and his plans to leave philosophy. The accompanying editorial notes are based on archival material not previously explored. Taken together, the correspondence provides an intriguing insight into Wittgenstein's life and thought, and will be essential reading for students and scholars. (shrink)

We investigate the role of legitimacy in setting organizational goals as a way to address the potential “dark,” unethical side of organizational goal setting. Coupling qualitative and quantitative research methods to better understand legitimacy in goal setting, we first induce novel hypotheses based on observed practice and then provide survey evidence to test the performance implications. Study 1 reports findings based on interviews with twenty-two company executives. We identify attention to goal credibility, prioritization of stakeholders directly involved in the goal’s (...) attainment when setting goals, and communication openness regarding goals, as well as their combination, as being important to organizational performance outcomes. Study 2 determines whether these three practices and their interaction predict performance using a survey conducted with 522 companies across four countries. Among other findings, we contribute to the organizational goal setting literature by showing that higher organizational performance is associated with the amount of priority given to the key actors (typically employees) directly involved with the goal’s attainment. We also find a positive interaction between attention to goal credibility, key actor (employee) importance, and communication openness on financial performance and non-financial goal attainment. Our work takes an initial step toward understanding how organizations can better shape the legitimacy of organizational goals for improved organizational performance and reduced unethical behavior. Organizational learning, at the broadest levels, as it has come to be understood within the organization theory and management literatures, concerns the experientially driven changes in knowledge processes, structures, and resources that enable organizations to perform skillfully in their task environments (Argote and Miron–Spektor, 2011). In this chapter, we examine routines and capabilities as an important micro–foundation for organizational learning. Adopting a micro–foundational approach in line with Barney and Felin (2013), we propose a new model for explaining how routines and (...) capabilities play a causal role in transforming experience into repertoires of (actual or potential) organization–level behavior. More specifically, we argue that routines and capabilities are built out of capacities for shared – both joint and collective – intentionality (Tomasello, 1999, 2014; Bratman, 1999a, 2014) that enable individuals to engage in complex forms of collaboration in conjunction with multiple layers of scaffolds that encompass material and symbolic resources, social processes, and cultural norms and practices (Weick, 1995; Hutchins, 1995; Clark, 1997, 2008; Orlikowski, 2007). In short, we outline what we call the ‘scaffolded joint action’ model and suggest its potential as a micro–foundation of organizational learning. (shrink)

Laws not only create public health agencies and fund them, but also authorize and impose duties upon government to protect the public's health while preserving individual liberties. As a result, law is an essential tool in public health practice and is one element of public health infrastructure, as it defines the systems and relationships within which public health (...) practitioners operate.For purposes of this paper, law can be defined as a rule of conduct derived from federal or state constitutions, statutes, local laws, judicial opinions, administrative rules and regulations, international codes, or other pronouncements by entities authorized to prescribe conduct in a legally binding manner. Studying his journals and notebooks takes us into his workshop, where we can see his entire universe of thought. We can witness the genesis of his published works, to be sure--but we can also see whole galaxies of concepts, new insights, and fragments, large and small, of partially completed but unpublished works. Rationale: Deep brain stimulation (DBS) of the hippocampus is proposed for enhancement of memory impaired by injury or disease. Many pre-clinical DBS paradigms can be addressed in epilepsy patients undergoing intracranial monitoring for seizure localization, since they already have electrodes implanted in brain areas of interest. Even though epilepsy is usually not a memory disorder targeted by DBS, the studies can nevertheless model other memory-impacting disorders, such as Traumatic Brain Injury (TBI). Methods: Human patients undergoing Phase II invasive monitoring for (...) intractable epilepsy were implanted with depth electrodes capable of recording neurophysiological signals. Subjects performed a delayed-match-to-sample (DMS) memory task while hippocampal ensembles from CA1 and CA3 cell layers were recorded to estimate a multi-input, multi-output (MIMO) model of CA3-to-CA1 neural encoding and a memory decoding model (MDM) to decode memory information from CA3 and CA1 neuronal signals. After model estimation, subjects again performed the DMS task while either MIMO-based or MDM-based patterned stimulation was delivered to CA1 electrode sites during the encoding phase of the DMS trials. Each subject was sorted (post hoc) by prior experience of repeated and/or mild-to-moderate brain injury (RMBI), TBI, or no history (control) and scored for percentage successful delayed recognition (DR) recall on stimulated vs. non-stimulated DMS trials. The subject’s medical history was unknown to the experimenters until after individual subject memory retention results were scored. Results: When examined compared to control subjects, both TBI and RMBI subjects showed increased memory retention in response to both MIMO and MDM-based hippocampal stimulation. Furthermore, effects of stimulation were also greater in subjects who were evaluated as having pre-existing mild-to-moderate memory impairment. Conclusion: These results show that hippocampal stimulation for memory facilitation was more beneficial for subjects who had previously suffered a brain injury (other than epilepsy), compared to control (epilepsy) subjects who had not suffered a brain injury. This study demonstrates that the epilepsy/intracranial recording model can be extended to test the ability of DBS to restore memory function in subjects who previously suffered a brain injury other than epilepsy, and support further investigation into the beneficial effect of DBS in TBI patients. That George Eliot was deeply interested in Spinoza is well known. She translated part of Benedict de Spinoza's Tractatus Theologico-Politicus as early as 1842, and completed a full translation of the Ethics by 1856. This might lead one to think that in her novels, Eliot applied the insights of Spinoza by showing them at work in the lives of her characters. In the novels of George Eliot, Thomas Hardy, and D.H. Lawrence a miniature history of the English working class can be found. Through their sympathetic portrayals, these authors transformed working-class culture from a patronizing pastiche into a vital reality. This achievement was crucial to the rise of the English working-class as the key agency of democratic reform from the mid-nineteenth to the mid-twentieth century. In our own times, by contrast, depictions of working-class culture are patronizing at best, if not (...) openly denigrating. This crisis of representation has born recent fruit in the phenomenon of populism, a long-term consequence of the undermining of genuinely popular rule under neoliberal capitalism. Returning to the works of Eliot, Hardy, and Lawrence in this book the author offers a sense of direction for contemporary politics, by rediscovering the vital force of working-class culture. This chapter focuses specifically on the case of pain. Despite traditional opposition to the representational thesis, the latter has won widespread assent. The most important early proponents of the representational thesis were David Armstrong and George Pitcher, both of whom held that pain is a form of perception. Following Armstrong and Pitcher, intentionalists have traditionally held that the experience of pain has a content with roughly the following form: there is a disturbance with such-and-such features at location L. Since (...) the internal states associated with the experience of pain arguably track local physical properties of disturbances, it seems that the tracking intentionalist must identify the pain qualities represented by pain experience with these physical properties. Comparatively little has been done on thoroughly evaluating Kant’s normative claims of international justice, particularly with regard to his ideal corpus of international law and his concrete recommendations for moving from a global state of nature to a cosmopolitan civil society.1In this paper, I would like to contribute to the latter task by focusing on the moral problem that war poses as, arguably, the most frequent and severe cause [End Page 323] of ruptures in the functioning of the international system.2 In particular, I would like to argue in favour of the controversial, and original, thesis that Kant has a just war theory.3 I would then like to develop that theory in some detail and to explain its strength and suggestiveness. The focus on war seems both helpful and timely. It is helpful in that it provides a specific, graphic example with which one can apprehend more clearly the abstract architecture of Kant’s international vision. It is timely in that, in the wake of the very recent conflicts in Bosnia and Rwanda, and in light of the subsequent formation of the International War Crimes Tribunals at The Hague, renewed attention has been paid to considering what, if anything, constitutes a just war and what is permitted, and what punishable, in terms of conduct in war. A rigorous consideration of what one of the true giants of moral philosophy thought about these issues can only serve to illuminate our understanding of these current events.1. THE TRADITIONAL READING OF KANT: NO JUST WARNearly every commentator on Kant’s international theory of justice who discusses the problem of war in any detail believes that Kant not only has no just war theory, but that he is, moreover, a vicious critic of the core propositions of classical just war theorists, such as Augustine, Aquinas, and Grotius. Howard Williams, for example, says that “Kant has no theory of just war … (j)ustice and war are in conflict with one another and it is our duty as human beings to try to overcome war.” Fernando Teson contends that “Kant dismisses the idea that there could be a just war” and Georg Geismann asserts that, for Kant, “there is no such thing as a just war.” Similarly, W. B. Gallie asserts that “Kant agreed … that nothing but confusion and harm resulted from regarding any wars as just … ” There is a bevy of quotes in the Kantian corpus to support this reading.4One prominent anti-just war quote occurs in Perpetual Peace, when Kant [End Page 324] reflects on the contributions of traditional just war theorists and arrives at the following judgment:It is therefore to be wondered at that the word right has not been completely banished from military politics as superfluous pedantry, and that no state has been bold enough to declare itself publicly in favour of doing so. For Hugo Grotius, Pufendorf, Vattel and the rest (sorry comforters as they are) are still dutifully quoted in justification of military aggression, although their philosophically or diplomatically formulated codes do not and...
